deciding with whom you wish to communicate.

1. Overview of our Privacy Policy.
In accordance with California Civil Code Section 1798.83 (effective January 1,
2005), the Web sites we design and maintain collect personal information about
you, such as your name, address(es), electronic mail address, telephone number
and, depending on the information you provide, details of your real estate and
lending needs and preferences. Through
our or your Affiliate's Web site, you may also request reports, a valuation of
your home, or even request information on a specific property. We collect the information you provide to us
when submitting your personal information online. This information will be sent directly to
your Affiliate, who may contact you.
It is possible to use your Affiliate's Web site without submitting any personal
information, but to take advantage of the products and services offered, you
will be required to enter some of your personal information.
On occasion, you may also request products or services from VREO's or your
Affiliate's Web site that are more substantial or personal in nature. This may include applying for a loan or
making an online purchase. The
information required to complete the request for these services may be used in
the following ways:
- For services provided by your Affiliate, your Affiliate will use your information
to provide the service(s) you requested. As may be required, your information may be shared with third parties to
complete the request. For example, any
financial information you provide to complete an order for services will be
used to process any associated payments.
- For products and services offered by a third party through our or your Affiliate's
Web site, your information may be shared with the third party to provide you
with the product(s) or service(s), or the third party may independently gather
your personal information. You will be
able to tell if a product or service is being offered by a third party because
the page on our or your Affiliate's Web site will be "co-branded"
with that of the third party, or you will be linked directly to the third party
Web site for completion of the transaction. As is described more particularly in Section 10 below, each company
linked to this Web site has its own privacy policy. Please check the privacy policy of each
company before you purchase a product or use a service. If you are uncomfortable about a company's
privacy policy, you should consider not purchasing their products or using
their services.
2. How is your personal information used?
When you use your Affiliate's Web site, your Affiliate may use your personal
information to contact you via phone, mail or e-mail to assist you with the
services you requested. Your Affiliate
may also use your address and e-mail address to send you information about his
or her services, and to help your Affiliate learn more about your real estate
preferences. You always have the choice not to receive marketing information mailings
or calls; you just need to let your Affiliate know.
VREO may use your information about your real estate interests to help improve our
site design and your online experience on your Affiliate's Web site. As for usage tracking data, VREO primarily uses
that information to operate and improve your Affiliate's Web site, and your
Affiliate may use that information to further his/her marketing efforts.
To serve you better, we may combine information you give us and information about
your real estate interests, including demographic information and information
that is publicly available. We may also
combine this information with information from our Affiliates. We use that combined information to enhance
our development of your Affiliate's Web site and to communicate with you in
accordance with this Privacy Policy.
3. Does VREO share my infomation with third parties other than our Affiliates?
VREO will share your information with our Affiliates so that our Affiliates can
communicate with you by e-mail or mail about their services and available
properties that may be of interest to you. Aside from our Affiliates, we will not share your information with any
other third party for marketing purposes.
VREO reserves the right to disclose information about you as required by law, in
response to legal process and law enforcement requests, and as necessary to
protect the property, interests and rights of VREO, its affiliates, and others.
4. How do I OPT OUT of recieving promotional communications?
Your Affiliate wants to communicate with you only if you want to hear from him or
her. If you prefer not to receive promotional
information from your Affiliate, you may OPT OUT of receiving your Affiliate's
promotional communications at no cost to you. You should be aware that you will need to OPT OUT each time you contact
one of our Affiliates from his or her Web site, contact an Affiliate
electronically by means of his/her Web site or save your information online.
To OPT OUT, please let us know by contacting your Affiliate using the contact
information available on his or her Web site. In fact, at the time you initially disclose your e-mail address, you may
indicate that you do not want your address used for direct mailings. If you initially accept direct mailings and
at a later date decide you wish to stop receiving them, you can type the word
"Unsubscribe" in an e-mail you receive from your Affiliate and send
it to your Affiliate, who should remove it from the subscriber list.
If you would like VREO's assistance in contacting your Affiliate, you may call us
at (805) 546-2020, e-mail us at privacy@vreo.com or mail your written
request to VREO Software, Inc., Attn:
Marketing Department – Privacy Policy Issues, 805 Aerovista Place, Suite 205,
San Luis Obispo, CA 93401. Please be
sure to include your full name and the addresses (mail and e-mail) you used
when you registered online with your Affiliate. If you ask us to have your name and address removed from one of our
Affiliate's contact lists, we will use our best efforts to contact your
Affiliate and request on your behalf that he or she maintain your name in his
or her "do not contact" list. Note that it may take up to four (4)
weeks for your Affiliate to process your OPT OUT request, during which time you
may continue to receive communications from your Affiliate.
If you would like to request information about what your Affiliate's Web site
collects, please feel free to call or write us as well. In accordance with California law, we will
respond in writing to your request within thirty (30) days.
5. How do I access my information? How do I change or delete my information?
In some cases, you may have the ability to update your personal information on
your Affiliate's Web site. You may also
call or write your Affiliate with your new information.
6. How does VREO protect children's privacy online?
VREO is concerned about the safety of children when they use the Internet and your
Affiliate's Web site. Children (persons
under the age of 18) are not eligible to use Web sites developed by us
unsupervised, and we ask that children do not submit any personal information
to a VREO-developed site. If you are
under the age of 18, you may only use our or your Affiliate's Web site in
conjunction and under the supervision of your parents or guardians. VREO will never knowingly request personally
identifiable information from anyone under the age of 18.
7. What are cookies? How does VREO use cookies on our and your Affiliate's sites?
A "cookie" is a small data file that Web sites often store on your
computer's hard drive when you visit their sites. A cookie may contain information, such as a
unique user ID that Web sites use to track the pages of the sites you visit. We use cookies but do not store personal information
in the cookie. We use cookies in order
to improve your online experience. Cookies enable us to keep track of your interests as you move around
your Affiliate's Web site.
Through our use of cookies, we also track the date and time you visit, the time you
spend, the Web pages you view, the other Web sites you visit, your search
queries and basic information about your computer such as your Internet
Protocol address, your domain name, your browser type, and the name of your
Internet service provider.
You can deactivate cookies by turning them off in your browser. If you turn off cookies, though, you may
hinder your online experience and you will be unable to receive or use some of
the features of your Affiliate's Web site.
8. How does VREO protext and use client information?
We are committed to protecting the security and integrity of our client
information, and we use procedures and technology designed for this
purpose. For example:
- We limit employee access to client information to those who have a business reason to know this information.
- We maintain policies and procedures covering the physical security of workplaces and records.
- We use technological means (such as backup files, virus detection software, firewalls and other computer software and hardware) to protect against unauthorized access or alterations to client data.
9. Is my information secure?
We believe your data must be protected against loss and unauthorized access. We use procedural and technical safeguards to
protect your personal information against loss or theft as well as unauthorized
access and disclosure to protect your privacy, including Secured Socket Layer
(SSL) technology and we require password authentication from any third party
companies that you've authorized to receive this information. While we employ many different security
techniques to protect such data from unauthorized access by users inside and
outside the company, perfect security does not exist on the Internet.
10. What about frames and links to other Web sites and services?
VREO's Web site may contain frames and links to other sites beyond VREO's
control. These sites may provide useful
tools including: real estate sales data, financial calculators and information
on selling or buying homes. VREO does
not control the privacy policies or practices of these Web sites. This Privacy Policy does not cover the
collection of information by those other companies and Web sites. Although we encourage third parties to
provide their own privacy policies, VREO and our Affiliates are not responsible
and shall not be liable for their activities, such as how they handle the
information they collect online. You
should review those policies before providing any personal information. We provide frames and links solely for the
convenience and information of our Affiliate's visitors.
11. Updates to our Privacy Policy?
We may amend this Privacy Policy at any time by posting the amended terms on our
or your Affiliate's Web Sites at www.vreo.com or on our Affiliate's Web
sites. All amended terms shall
automatically be effective thirty (30) days after they are initially posted on
the site.
12. Governing Law; Limitation of Damages.
This Privacy Policy is governed by the laws of the State of California. By your use of our site, you agree to be
bound by the terms and conditions contained in this Privacy Policy. To the extent you may maintain any claims for
liability against VREO arising from a potential violation of this Privacy
Policy or to the misuse of your personal information, you agree that your
recovery for damages is expressly limited to those provided in California Civil
Code Section 1798.84.
